IDLADS vs. Ministerio de Medio Ambiente (Acción de Cumplimiento, 04419-2023-0-1801-JR-DC-01)
The Peruvian Court of Justice in Lima upheld the “Action of Compliance” filed by the Instituto de Defensa Legal del Ambiente y el Desarrollo Sostenible Perú (IDLADS) against the Ministry of the Environment. The Court ordered the Ministry to comply with the provisions of the 17th Final Complementary Provision of the Regulations of the Framework Law on Climate Change (Law n. 30754), approved by Supreme Decree n. 013-2019-MINAM. In Peru, an “Action of Compliance” may be brought against “any authority or official reluctant to comply with a legal rule or administrative act”. Identificación. at p. 4. The Court analyzed whether the plaintiff’s claim met the minimum requirements for such an action and found that IDLADS was seeking enforcement of a mandate that “is in force”, “is true and clear”, “not subject to complex controversy or disparate interpretation”, and is “unavoidable and of mandatory compliance”. The relevant provisions, which the defendant failed to comply with, require the Ministry of Environment to develop a regulatory proposal that allows for the typification and sanctioning of actions related to acts or conducts punishable under forest carbon capture or sequestration and REDD+, in compliance with safeguards, to be submitted to the relevant authorities within one hundred and eighty days (180) from the approval of the Regulation. The Court found that, since the legal norm had been in force for over three years, the deadline to elaborate the new normative proposal was exceeded, and therefore the claim should be upheld.
