ARCA v Administración de la Comunidad de Castilla y León. Nullifying the decree approving the Plan for Managing Natural Resources of Fuentes Carrionas and Fuente Cobre-Montana Palentina (Palencia) Natural Space. (Provided by AJA thanks to
Decision no. 20 of the High Court of Castilla and Leon (appeals against administrative decisions) that states null and avoid Decree 13/2006, of 9 of March, amending Annex I of Decree 140/1998, of 16 of July, that approves the Plan for Managing Natural Resources of Fuentes Carrionas and Fuente Cobre-Montana Palentina (Palencia) Natural Space. Each party will cover its own costs.
The amendments introduced by the annulled Decree reduced the protection previously granted to the Natural Space by allowing alpine ski resorts, which were forbidden before. Among the grounds of the decision is the lack of economic viability of the ski resort projected due to the climate change effects. It seems this is the first time that a Spanish court uses the matter of climate change among the reasons to back a decision.
