Il s’agit d’un appel interjeté par un tiers opposant (ICAG) contre la décision du Ministre du Plan d’approuver l’extension d’une mine de charbon existante. Les objections soulevées dans cet appel portaient sur les impacts de l'extension de la mine de charbon sur la biodiversité (en particulier la grenouille géante barrée menacée), sur la qualité de l'eau, sur la santé à cause des particules, la pollution sonore et les émissions de poussières.
La Cour suprême chilienne a révoqué les permis environnementaux pour la construction de Central Castilla, qui aurait été la plus grande centrale électrique au charbon proposée en Amérique du Sud. Les promoteurs du projet ont soumis trois EIE distinctes pour la centrale électrique, une ligne de transmission et un port pour les importations de charbon. Appliquant le principe de précaution, la Cour suprême a déclaré que les projets devraient être évalués ensemble pour déterminer la zone d'influence réelle et les impacts cumulatifs.
The Court determined the decision of the Minister for Planning's to approve a coal mine extension project should be granted, but imposed extensive additional conditions on the approval based upon a precautionary approach. These additional conditions provide for more certain conservation of threatened species and biological diversity, protection of water quality, control of particulate emissions, mitigation of noise generated by the mine and noise and dust generated by the transportation of coal by train.
The Chilean Supreme Court revoked the environmental permits for the construction of Central Castilla, which would have been the largest proposed coal-fired power plant in South America. Project proponents submitted three separate EIAs for the power plant, a transmission line, and a port for coal imports. Applying the precautionary principle, the Supreme Court declared that the projects should be assessed together to determine the actual area of influence and cumulative impacts.
Applying the precautionary principle, the Supreme Court of the Philippines permanently banned field trials of genetically-modified crops, including Bt talong (eggplant), until a new administrative order on biosafety is adopted.
Decision by Secretary of the Interior to withdraw large parcels of land near Grand Canyon National Park to entry for uranium exploration and mining projects was not arbitrary or an abuse of discretion. Court approved the agency’s “cautious and careful approach” because of the risk of severe groundwater contamination from mining activities and threats to sacred and traditional places of tribal people.
The government of Kenya has an affirmative duty to publicly disclose a power purchase agreement with Ethiopia and information describing the possible social and environmental impacts of hydropower facilities in Ethiopia that would divert water flowing into Lake Turkana. The State must also ensure Lake Turkana is sustainably managed utilized and conserved, and exercise the necessary precautions in preventing environmental harm that may arise from any power purchase agreements with Ethiopia.
