Royaume d&#039;Espagne, CJCE C-404\/09 (2011) (Cour de justice europ\u00e9enne)<br \/>\n24 novembre 2011<\/p>\n<p>La Commission europ\u00e9enne a all\u00e9gu\u00e9 que le royaume d&#039;Espagne avait approuv\u00e9 deux projets d&#039;extraction de charbon \u00e0 ciel ouvert sans \u00e9valuer correctement les impacts environnementaux directs, indirects et cumulatifs des mines. Entre autres choses, la Commission a fait valoir que les \u00e9valuations d&#039;impact environnemental de chaque mine ne tenaient pas compte des impacts cumulatifs de plusieurs mines \u00e0 ciel ouvert exploit\u00e9es simultan\u00e9ment et situ\u00e9es \u00e0 proximit\u00e9 les unes des autres. (La Commission avait inclus un troisi\u00e8me projet d&#039;extraction de charbon, mais la plainte relative \u00e0 ce projet a \u00e9t\u00e9 rejet\u00e9e car la demande d&#039;autorisation pour la mine a \u00e9t\u00e9 soumise \u00e0 une \u00e9poque o\u00f9 la directive EIE de l&#039;Union europ\u00e9enne ne s&#039;appliquait pas aux mines \u00e0 ciel ouvert).&nbsp;<\/p>\n<p>La Cour europ\u00e9enne a d&#039;abord pr\u00e9cis\u00e9 que l&#039;analyse des effets cumulatifs est une partie obligatoire du processus d&#039;EIE et n&#039;est pas discr\u00e9tionnaire. Voir par. 77. Il a d\u00e9clar\u00e9 qu&#039;une EIE doit inclure \u00ab une analyse des effets cumulatifs sur l&#039;environnement que ce projet peut produire s&#039;il est consid\u00e9r\u00e9 conjointement avec d&#039;autres projets, dans la mesure o\u00f9 une telle analyse est n\u00e9cessaire pour garantir que l&#039;\u00e9valuation couvre l&#039;examen des tous les impacts notables sur l\u2019environnement du projet en question. Id., par. 80. La Cour a d\u00e9clar\u00e9 que les \u00e9valuations pr\u00e9par\u00e9es avant l&#039;autorisation des deux mines de charbon \u00e9taient inad\u00e9quates parce qu&#039;elles ne comportaient pas d&#039;analyse des effets cumulatifs.<\/p>\n<p>Le royaume d\u2019Espagne a tent\u00e9 de rem\u00e9dier aux d\u00e9fauts des EIE en produisant un rapport pr\u00e9par\u00e9 apr\u00e8s le d\u00e9but du litige et plusieurs ann\u00e9es apr\u00e8s l\u2019autorisation des mines, \u00e9valuant les impacts combin\u00e9s des mines de charbon. La Cour a rejet\u00e9 cette approche, affirmant que les EIE d\u00e9fectueuses ne pouvaient pas \u00eatre corrig\u00e9es par le rapport post hoc car une analyse des impacts cumulatifs doit \u00eatre men\u00e9e avant qu&#039;un projet soit autoris\u00e9 \u2013 et non apr\u00e8s coup.
