Les citoyens et les organisations de la soci\u00e9t\u00e9 civile ont d\u00fbment pr\u00e9sent\u00e9 des p\u00e9titions pour la mise en place de proc\u00e9dures de participation citoyenne au cours du processus d&#039;\u00e9valuation de l&#039;impact environnemental (EIE) requis pour ce projet compl\u00e9mentaire propos\u00e9, mais ces p\u00e9titions ont \u00e9t\u00e9 rejet\u00e9es. Le refus de ces requ\u00eates a fait l&#039;objet d&#039;un appel sans succ\u00e8s au niveau administratif et le projet propos\u00e9 visant \u00e0 incorporer le dynamitage a \u00e9t\u00e9 approuv\u00e9, ce qui a donn\u00e9 lieu \u00e0 un proc\u00e8s constitutionnel (<em>recurso de protec<\/em><em>ci\u00f3n<\/em>) a \u00e9t\u00e9 intent\u00e9e en faisant valoir la violation du droit constitutionnel \u00e0 un environnement sain et en demandant l&#039;invalidation des refus administratifs des p\u00e9titions de participation ainsi que l&#039;ordonnance de pr\u00e9voir des proc\u00e9dures de participation citoyenne avant d&#039;approuver le projet. &nbsp;<\/p>\n<p>Mina Invierno a soutenu que le refus des demandes de participation citoyenne \u00e9tait conforme \u00e0 la loi et \u00e0 la r\u00e9glementation sur l&#039;EIE, car les m\u00e9thodes de dynamitage pour l&#039;exploitation mini\u00e8re ne font pas partie des cat\u00e9gories de projets \u00e9num\u00e9r\u00e9s dans la r\u00e9glementation et soumis aux proc\u00e9dures de participation citoyenne. La Cour supr\u00eame du Chili n&#039;est pas d&#039;accord et a d\u00e9termin\u00e9 que la liste des projets \u00e9num\u00e9r\u00e9s dans les r\u00e8glements de l&#039;EIE n&#039;est pas exhaustive, que tout projet qui entra\u00eene des impacts environnementaux n\u00e9gatifs peut \u00eatre soumis \u00e0 des proc\u00e9dures de participation citoyenne (s&#039;il est d\u00fbment d\u00e9pos\u00e9) et que le projet de Mina Invierno d&#039;incorporer les m\u00e9thodes de dynamitage auront des impacts environnementaux n\u00e9gatifs et pourront donc \u00eatre soumises \u00e0 des proc\u00e9dures de participation citoyenne.
