PHOTO\u00a0: Xinhua\/Alamy<\/figcaption><\/figure><\/div>\n\n\n\n<p>La semaine derni\u00e8re, la Cour supr\u00eame du Sri Lanka a rendu une d\u00e9cision&nbsp;<a href=\"https:\/\/elaw.org\/fr\/resource\/lk_xpresspearl_24july2025\/\" target=\"_blank\" rel=\"noreferrer noopener\">d\u00e9cision historique<\/a>, ordonnant \u00e0 une compagnie maritime singapourienne et \u00e0 des parties li\u00e9es de payer une indemnisation initiale de 14 milliards de livres sterling pour dommages environnementaux.<\/p>\n\n\n\n<p>Fin mai 2021, le cargo X-Press Pearl a pris feu au large des c\u00f4tes sri-lankaises. Douze jours plus tard, il a coul\u00e9, provoquant l&#039;une des pires catastrophes maritimes de l&#039;histoire. Le CEJ a fait appel au r\u00e9seau ELAW pour un soutien scientifique, des exemples de dommages et int\u00e9r\u00eats demand\u00e9s lors d&#039;autres catastrophes maritimes, et plus encore.<\/p>\n\n\n\n<p>Cette d\u00e9cision historique aura des r\u00e9percussions sur le secteur du transport maritime. Le premier versement, d&#039;un montant de 14,4 milliards de pesos tanzaniens, doit \u00eatre effectu\u00e9 avant le 23 septembre 2025. Un montant suppl\u00e9mentaire de 14,4 milliards de pesos tanzaniens devra \u00eatre vers\u00e9 dans les six mois suivant le jugement, et le dernier versement, d&#039;un montant de 14,4 milliards de pesos tanzaniens, est d\u00fb dans un d\u00e9lai d&#039;un an.<\/p>\n\n\n\n<p>La Cour a confirm\u00e9 et appliqu\u00e9 le principe du \u00ab pollueur-payeur \u00bb, affirmant qu&#039;il \u00e9tait d\u00e9sormais int\u00e9gr\u00e9 au droit sri-lankais. En outre, elle a cr\u00e9\u00e9 une Commission d&#039;indemnisation et un Comit\u00e9 de restauration compos\u00e9s d&#039;experts, charg\u00e9s de poursuivre l&#039;\u00e9valuation des dommages environnementaux persistants et des moyens de les r\u00e9parer.
